Terms and Conditions
- Authority to Enter Agreement The customer warrants that they are the owner of the property where the works are to be conducted or have the authority from the owner or their agent to enter into this agreement.
- Access to Site The customer shall provide the company possession of the site where the works are to be undertaken and ensure that the company has access to the said site at all times.
- Provision of Power and Lighting The customer shall ensure the availability of power and lighting at all times during the installation to avoid disruptions caused by a lack of power.
- Commencement and Completion of Works The company shall begin the installation as soon as possible and proceed to completion within a time frame based on normal working hours. The work will be conducted in a good and workmanlike manner, considering the circumstances of the installation and aiming for a timely completion.

Extension of Time Notwithstanding Clause 4, the time to complete the works shall be extended in cases of:
- Delays caused by the customer’s actions.
- Force majeure.
- Exceptional inclement weather Loss or damage caused by fire or other risks.
- d. Instructions issued by or on behalf of the customer for additional work.
- Warranty and Standards Subject to compliance with these terms and conditions by the customer, the company warrants that all work will be performed in accordance with applicable Australian Standards.
- Variations and Modifications Any instructions for variations or modifications must be provided by the customer in writing. Costs related to additional work or changes to instructions will be treated as a variation to the contract sum and added accordingly.
- Timber Variations The customer acknowledges that timber is a natural product and subject to variations in colour. The customer agrees not to raise objections or claims for compensation due to colour variations.
- Floor Levelling and Subfloor Conditions The quotation does not include floor levelling, stabilising, repair, or waterproofing of the timber floor or subfloor. Any required rectification constitutes a variation. The company is not responsible for inherent defects in the subfloor or timber surface that become apparent after installation. Changes in moisture content, subfloor ventilation, vermin infestation, structural instability, concrete additives, or undisclosed thickened beams also constitute a variation. If defects are identified before installation, the company may delay works until the defects are rectified by the customer.
- Cancellation of Contract by Customer If the customer requests cancellation at any time, they shall be liable for payment of work completed and materials prepared or set aside for the contract.
- Mutual Agreement for Cancellation. No contract can be cancelled without mutual agreement in writing.
- Retention Following Completion. Under no circumstances shall the customer hold retention following the completion of installation.
- Non-Payment by Customer If the customer fails to make any payment by its due date as stated in the sales order terms, the company reserves the right to cease all work immediately and recommence only upon receipt of payment, at a time convenient to the company.
- Damage to Property. Except in cases of negligence by the company, its employees, agents, or contractors, the company shall not be responsible for any damage to the property, including household items such as furniture and electrical goods. The customer must ensure their own insurance coverage for such losses.
- Insurance by the Company The company shall maintain its own insurance coverage for workers' compensation and public liability claims arising during or as a result of the works.
- Errors in Quotation: If there is an error in the calculation of the quotation, the company reserves the right to amend the price payable by the customer to reflect the correct amount for the work undertaken. In such cases, either party has the option to cancel the contract.
- Customer Responsibilities The customer is responsible for moving and reconnecting power points, fridges, washers, stoves, and dishwashers. The customer must also ensure that the installation areas are clear and provide free access for tradesmen.
- Skirting Removal and Reinstallation The company is not responsible for the removal or reinstallation of skirting boards unless explicitly included in the quotation. If skirting removal or reinstallation is required and not included, this will constitute a variation to the contract and additional charges will apply. The company shall not be responsible for any damage caused during the removal of skirting. If damage occurs to the skirting, the customer is responsible for providing replacement skirting of the same or similar type. The company may assist in sourcing or providing skirting at additional costs.
- Door trimming the company assumes no liability for door trimming or adjustments. Such services may be performed by installers for an additional fee; otherwise, all responsibility for adjustments rests solely with the customer.
- Expansion Joints During the installation process, our highly skilled and professional installers will assess the need for expansion joints. If deemed necessary, customer approval is required prior to installation. Failure to provide approval will void the installation warranty.
- Furniture Removal is the sole responsibility of the customer unless otherwise agreed upon. If requested, our team may provide furniture removal services for an additional fee.
Installation and Manufacturer Warranty
Manufacturer Warranty
The manufacturer is responsible for all product warranties, including those related to wear, defects, stains, and soils. In such cases, it is the manufacturer’s responsibility to assess and if the product is found to be faulty, then the manufacturer will replace the faulty products within the warranty period.
Generally, it is a product warranty only, which means the product will be replaced as supply only.That means that removing, clearing the area of faulty products and labour costs to reinstall is generally not covered.
Manufacturer's warranty is generally found from the website of the manufacturer. We can also assist in supplying the manufacturer's warranty document to the customer.
Installation
At Prestige Floor, we offer a 1-year installation warranty for all floor covering products we install, ensuring any issues arising from the installation process are promptly addressed. Our trained subcontractors aim for excellence in their workmanship, we understand that minor errors may occur; hence, we take responsibility for their work.
It's important to note that we cannot be held liable for sub-floor defects that only become apparent after installation, such as changes in moisture content, concrete additives, ventilation issues, or structural stability concerns, unless these are disclosed by the client beforehand.
The customer is responsible for the floor leveling of their home. Either the customer can carry out the floor leveling themselves, or the customer can request that the floor leveling be carried out by our sub-contractors. If the customer chooses patch leveling, there is no guarantee the floor will be stable, and we cannot be held liable for sub-floor defects that only become apparent after installation, such as changes in moisture content, concrete additives, ventilation issues, or structural stability concerns.
We encourage customers to have their floor fully levelled prior to installation to ensure the best outcome for stability and minimise issues that may arise from the sub-floor.
Our warranty does not cover damage from improper maintenance, environmental factors, or alterations made post-installation. Your satisfaction is our priority, and we are committed to providing exceptional flooring solutions and support.
